
OGDEN, Utah — Less than a year after the tragic death of 12-year-old Gavin Peterson, his father has received the maximum sentence. Gavin passed away on July 9, 2024, at a Weber County hospital, and just days later, three family members were arrested in connection with his death.
The Utah Division of Child and Family Services (DCFS) later released documents showing that Gavin had been subjected to years of abuse, including “severe and chronic physical abuse and neglect,” as outlined in their investigative report.
In a sentencing hearing today, Shane Jesse Peterson, Gavin’s father, appeared in court after pleading guilty in March. He admitted to five felony charges, including one count of child abuse homicide, three counts of aggravated child abuse, and one count of child endangerment.
Shane Peterson was sentenced to five years to life for the child abuse homicide charge, along with three separate 1 to 15-year sentences for aggravated child abuse. Additionally, he received a sentence of up to five years for child endangerment. These sentences are to run consecutively, adding up to a lengthy term of incarceration.
Before issuing the sentence, Judge Camille L. Neider, of the Second District Court, addressed Shane Peterson.
“I believe the maximum sentence is appropriate,” Judge Neider remarked. “I will also urge the board to keep you incarcerated for the remainder of your life.”
The judge, visibly emotional, expressed the gravity of the case and the suffering Gavin likely endured.
“Gavin likely experienced unimaginable pain leading up to his death,” Judge Neider said, her voice breaking. She turned directly to Shane Peterson, telling him, “You were his father. I don’t believe you deserve that title anymore, but unfortunately, nothing can take that away.”
The judge also noted the stark contrast between her emotions and Peterson’s apparent lack of remorse.
“I am more upset about this than you are,” Judge Neider added.
Nichole Lea Scott, Gavin’s stepmother, also faces charges in the case. She pleaded guilty on April 7 to charges including murder, child abuse, obstruction of justice, and endangerment of a child. Her sentencing is scheduled for May 12.
Tyler Shane Peterson, Gavin’s brother, has been released for treatment based on mental health recommendations from his defense attorney. While Tyler pleaded guilty alongside his father, his sentencing has not been finalized. Tyler’s case will be reviewed on May 22, where the court will assess his treatment progress.
The Peterson family’s case has drawn widespread attention, and while the legal process continues, the lasting impact of Gavin’s abuse and tragic death remains a sorrowful reminder of the dangers of neglect and violence in the home.
