$6,500 Settlement for Seniors Affected by Data Breach – How to Claim Your Money

Senior citizens impacted by a significant data breach could receive up to $6,500 in compensation—all they need to do is provide supporting documentation, such as a bank statement.

Luxury senior living company Vi has agreed to settle a class action lawsuit following a March 13, 2023, cyberattack that exposed residents’ personal information, including names, Social Security numbers, financial details, and medical records. While Vi denies any wrongdoing, the settlement provides financial relief and identity protection for those affected.

Settlement Payment Details

The compensation available through the settlement falls into two categories, based on the financial losses suffered:

  • Ordinary Losses – Up to $1,500
This category covers common financial burdens, including:

    • Bank fees
    • Travel costs
    • Credit monitoring expenses
    • Communication charges
    • Compensation for up to seven hours of lost time at $25 per hour

To claim lost time, individuals must provide documentation or a written explanation linking their time spent to an out-of-pocket loss.

  • Extraordinary Losses – Up to $5,000
Those who experienced more severe financial harm—such as fraud or identity theft—linked to the Vi data breach may qualify for higher compensation.

Additionally, all individuals affected by the breach will receive two years of free Medical Shield Complete Monitoring, which includes:

  • $1 million in medical identity theft insurance
  • Real-time monitoring of medical records

Other Data Breach Settlements

This settlement follows another major case in California, where victims of the Hapy Bear Surgery Center data breach may be entitled to payments of up to $8,050.

The Hapy Bear Surgery Center, a pediatric dental facility in Tulare, faced a lawsuit after a December 27, 2023, data breach exposed patients’ names, Social Security numbers, health insurance details, and medical records. Plaintiffs argued that the company failed to implement proper cybersecurity measures to prevent the breach.

Eligible individuals can receive:

  • Up to $500 for out-of-pocket expenses, including bank fees, credit monitoring, and communication costs
  • Up to $7,500 for significant unreimbursed losses due to fraud or identity theft
