Americans affected by a 2023 data breach at Hapy Bear Surgery Center in California may be eligible for a settlement payment of up to $8,050, but they’ll need specific documentation to file a claim.

Hapy Bear Data Breach Settlement

Hapy Bear Surgery Center, a pediatric dental surgery facility in Tulare, California, reached a class action settlement after allegations that it failed to safeguard patient data. The breach reportedly exposed sensitive information, including:

  • Names
  • Social Security numbers
  • Health insurance details
  • Medical records

Plaintiffs argued that the breach could have been prevented had the center implemented stronger cybersecurity measures.

Who Qualifies for Compensation?

Anyone whose personal information was compromised as of December 27, 2023, or who received a data breach notification may be eligible for payment.

Payout details include:

  • Up to $500 for standard out-of-pocket costs (e.g., bank fees, credit monitoring, communication expenses)
  • Up to $7,500 for substantial financial losses due to fraud or identity theft
  • An additional $50 for California residents

All approved claimants will also receive two years of free credit monitoring, which includes:

Another Active Settlement: Daily Harvest Food Poisoning Case

In addition to the Hapy Bear case, another settlement is offering compensation to consumers impacted by Daily Harvest’s French Lentil + Leek Crumbles.

If you purchased, consumed, or received the crumbles in 2022 and suffered injuries or financial losses, you could receive up to $173,330. The product, sold online and in Chicago and Los Angeles stores, contained tara flour, which was allegedly contaminated with salmonella.

The FDA reported 393 cases of illness and 133 hospitalizations across 36 states. Compensation amounts vary based on the severity of the case:

  • Up to $665 for monetary losses related to another person’s illness (Category 1A)
  • Up to $1,335 for individuals who got sick but did not seek medical treatment (Category 1B)
  • Up to $20,000 for those who required medical treatment but were not hospitalized (Category 2)
  • Up to $40,000 for hospitalized patients (Category 3)
  • Up to $173,000 for those who had to undergo gallbladder removal surgery (Category 4)
