Data Breach Payout: How to Get Your $5,000 From Physical Therapy Settlement

A major settlement is underway following a class-action lawsuit against Upstream Rehabilitation, a physical therapy company accused of failing to protect client data in a 2023 data breach. The breach, which occurred in two separate windows—January 24 to 31, 2023, and February 3 to 9, 2023—resulted in personal health information being exposed to hackers and third parties.

Settlement Details

Upstream Rehabilitation, which operates 1,200 locations nationwide, has agreed to a $4.3 million settlement to resolve the claims. While the company denies any wrongdoing, the settlement aims to avoid further legal costs and compensate those impacted by the breach.

Eligibility & Claim Filing

To be eligible for compensation, individuals must have had their personal health data exposed during the breach periods. Affected individuals should have already received a notice with a Unique ID and PIN to file a claim on the settlement website. Those who didn’t receive the ID can download a paper claim form and submit it by mail.

Payment Information

Filing a claim requires no proof of loss, but providing documentation such as credit expenses, identity theft damages, or fraudulent charges can lead to a higher payout—up to $5,000 for documented losses. All eligible claimants will receive three years of free credit monitoring services.

Even without documentation, claimants will receive a pro-rata share of the settlement fund. The current estimated payout is around $50 per claimant, though this amount may fluctuate depending on the total number of claims filed.

Important Deadlines

The deadline for filing claims is January 30, 2025. The deadline to exclude oneself from the settlement or object has already passed, on December 31, 2024. A final approval hearing is scheduled for February 24, 2025, and payouts are expected shortly afterward.
