Hurry! Last Chance for Healthy Eaters to Get Up to $173,330 from Food Poisoning Payout
Users of a meal delivery service could soon be eligible for a significant payout from a multi-million dollar settlement after allegations of food poisoning.
Customers who purchased, received, or consumed the Daily Harvest French Lentil and Leek Crumbles in 2022 need to act quickly. A class-action lawsuit has claimed that the product caused food poisoning due to contamination concerns with tara flour, a gluten-free flour made from tara tree seeds. The lawsuit accused Daily Harvest of failing to adequately test the flour for potential toxins before using it in the crumbles, exposing customers to harmful bacteria and resulting in serious injury.
Daily Harvest has agreed to pay a $7.67 million settlement but denies any wrongdoing. This comes after a previous settlement in 2023, where the company paid $22.99 million to resolve similar claims.

Eligible Claimants and Payout Categories
Customers who consumed the affected French Lentil and Leek Crumbles in 2022 and experienced personal injuries or financial losses may be entitled to compensation. The settlement provides varying payouts based on the severity of the damage caused:
- Category 1A: Customers who did not suffer personal injuries but lost money due to the incident can receive up to $665.
- Category 1B: Claimants who personally suffered injuries but did not require medical treatment are eligible for up to $1,335.
- Category 2: Individuals who sought medical treatment but were not hospitalized can get up to $20,000.
- Category 3: Customers who were hospitalized after consuming the crumbles can claim up to $40,000.
- Category 4: The most severe cases, including individuals who underwent gallbladder removal surgery (cholecystectomy) due to consumption, may be eligible for up to $173,330.
The exact payout for each category will be determined once all claims are submitted.

Important Deadline
Class members must file claims by January 21 to be eligible for compensation. Claims should be supported by evidence such as receipts, medical records, or bills that show the personal injuries or financial damages incurred.
Exclusion Deadline Passed
The deadline to exclude oneself from the settlement has already passed (December 11). If class members did not exclude themselves, they must submit a claim to receive compensation from the payout.
A final approval hearing for the settlement is scheduled for March 3.
In other news, drivers may also be eligible for a share of a $1.2 billion payout, offering additional potential compensation.
