Up to $5,000 Available in Physical Therapy Data Breach Settlement – No Proof Required
Americans may soon be eligible for direct payments from a class action settlement with no proof required. The case involves Upstream Rehabilitation, a nationwide physical therapy company accused of mishandling client data during a breach in 2023.
The breach occurred between January 24-31 and February 3-9, 2023, exposing sensitive personal information such as birthdates, names, health diagnoses, and insurance details. Plaintiffs claim Upstream Rehabilitation did not have adequate cybersecurity measures in place to prevent the leak. Although the company has not admitted fault, it agreed to a $4.3 million settlement to avoid additional legal costs.
Eligibility and Filing a Claim
To qualify for a payment, individuals must have had their health information exposed during the breach. Those who are part of the class action should have received a notice with a Unique ID and PIN to file a claim. If you didn’t receive the notice, you can still download a paper claim form from the settlement website and submit it by mail.

Payment Details
No proof is required to submit a claim, but claimants who provide documentation of losses—such as credit expenses, fraudulent charges, or identity theft—may receive up to $5,000. These claimants will also be entitled to three years of free credit monitoring. Those without documentation of losses will receive a proportional share of the settlement, with an estimated payout of around $50 per claimant, though this could fluctuate based on the number of claims filed.
Important Deadlines
Claimants must file their claims by January 30, 2025. The deadline for exclusion and objections passed on December 31, 2024. A final approval hearing for the settlement is set for February 24, 2025, and funds are expected to be distributed shortly after.

In addition to the Upstream Rehabilitation settlement, there are other ongoing settlements. Hospital patients may receive up to $5,000 in a separate case, and individuals affected by food poisoning could be eligible for checks up to $173,330.
