Act Fast! Healthy Eaters Can Claim Up to $173,330 from Food Poisoning Settlement
Users of a popular meal delivery service, Daily Harvest, could be entitled to a significant payout following a class-action lawsuit accusing the company of causing food poisoning.
Customers who purchased, received, or consumed Daily Harvest’s French Lentil and Leek Crumbles in 2022 must act quickly to claim a portion of the $7.67 million settlement. The lawsuit alleged that the meal caused food poisoning due to contamination with a gluten-free flour made from tara tree seeds, which can carry a risk of salmonella.
The recall of the French Lentil and Leek Crumbles was initiated after it was discovered that the tara flour had not been adequately tested for salmonella contamination before being used. The plaintiffs in the case argue that Daily Harvest exposed its customers to the bacteria, resulting in serious health issues.
Salmonella infections, which are caused by ingesting the bacteria, are a leading cause of foodborne illness and can lead to severe symptoms such as stomach cramps, diarrhea (sometimes bloody or mucousy), vomiting, nausea, and fever. In more severe cases, the infection can spread to other parts of the body.

While Daily Harvest has agreed to pay the $7.67 million settlement, the company does not admit to any wrongdoing. This payout comes after a similar settlement last year in which Daily Harvest agreed to pay $22.99 million to resolve related claims.
Eligible customers who purchased, received, or consumed the affected French Lentil and Leek Crumbles and suffered injuries or financial losses can now claim a portion of the settlement. Payment categories vary based on the severity of the injuries and damages:
- Category 1A: Customers who didn’t suffer personal injuries but lost money due to another person’s injuries may receive up to $665.
- Category 1B: Those who suffered injuries but did not seek medical treatment can receive up to $1,335.
- Category 2: Customers who received medical treatment but weren’t hospitalized can receive up to $20,000.
- Category 3: Claimants who were hospitalized due to their injuries may receive up to $40,000.
- Category 4: Those who had a cholecystectomy (gallbladder removal) due to their injuries can receive up to $173,330.
The exact amount each claimant will receive depends on the total number of claims filed.
Those wishing to participate in the settlement must submit claims by January 21, 2025, and provide proof of injury or financial loss, such as receipts or medical records. The deadline to exclude oneself from the settlement has passed, but those who did not opt out must file a claim to receive compensation.
A final approval hearing for the settlement is scheduled for March 3, 2025.
In addition to the Daily Harvest settlement, a number of drivers are also eligible for a share of a $1.2 billion payout related to other claims.
