Americans have just a few weeks left to claim compensation of up to $5,000 from a data breach settlement, and they only need one key document to do so.
Mulkay Cardiology Consultants in New Jersey has reached a class action settlement after being accused of failing to adequately protect patients’ sensitive data. In early November 2023, the company revealed it had been targeted by cybercriminals who used ransomware to access the personal health information of approximately 80,000 individuals.
This breach occurred between September 1 and September 5, 2023, and affected anyone who received a notification about the compromise of their data. Allegedly, Mulkay did not have sufficient security measures to prevent the attack, which exposed highly sensitive data like Social Security numbers and health insurance details.
While Mulkay is not admitting any fault, they have agreed to pay an undisclosed amount to settle the claims. Individuals who are part of the class action can be reimbursed for any out-of-pocket costs caused by the breach, including expenses such as bank fees, communication charges, travel costs, and credit-related expenses.
In addition, plaintiffs can also claim compensation for the time spent dealing with the aftermath of the breach, capped at three hours, valued at $25 per hour.
For ordinary claimants, the payout is limited to $500, but those who experienced significant losses can seek up to $5,000 in additional reimbursement. Alternatively, class members can choose a one-time payment of $48.
All participants in the settlement are eligible for two years of free credit monitoring services as well.
To file a claim, class members must submit a valid form by February 22, 2025. A final approval hearing for the settlement is set for April 11, 2025.
In a separate case, Americans also have a limited time to secure a portion of a $20 million settlement from Apple. This settlement involves claims that certain Apple Watch models were defective and prone to causing expensive issues, and no receipt is required to claim a share of the settlement.
